Developing a variety of services designed to maximize reimbursement and
counter the abusive payment practices of insurance carriers which plague medical
providers, James “Jay” Packer, J.D., recently joined HRA Medical
Management, Inc. as chief counsel of its legal department. As an attorney
with litigation experience, Mr. Packer enhances HRA’s ability to enforce
reimbursement rights to the fullest extent permitted by law. In particular,
Mr. Packer oversees HRA’s assertion of medical liens on behalf of providers,
workers compensation matters including negotiation, hearings and trial, creditor
suits, and issues involving insurance carriers who routinely take advantage
of providers by practicing abusive payment patterns.
In the context of billing for emergency medical care, Mr. Packer utilizes
statutory law (long used by large hospitals) to assert medical liens on claims
made by patients against third parties responsible for their injuries. Consequently,
the interests of HRA’s clients are represented by an experienced attorney
when negotiating medical liens and settling accounts. The net effect is an
overall increase in attorney cooperation and an overall decrease in the administrative
costs and time-loss associated with collection efforts involving liable third
parties.
Mr. Packer also heads HRA’s commitment to fighting unfair payment practices
of insurance companies who routinely abuse their power by delaying and denying
payments in violation of the law. As all providers are aware, receiving reimbursement
from large insurance carriers is a daunting, often fruitless task that erodes
timely and efficient monetary recovery. To fight such abusive practices, Mr.
Packer utilizes various laws designed to protect providers by analyzing payment
histories of specific payors to reveal potential violations. Violations, when
properly reported to appropriate government agencies, often entitle providers
to penalties and interest which are often overlooked by physicians groups
lacking legal sophistication and experience in this area.
To facilitate the recovery system, Mr. Packer works closely with HRA’s
Collection Department and uses HRA’s state-of-the-art information management
system, the AS/400, for early detection of matters appropriate for client
liens. This enables HRA to focus its administrative efforts on non-lien related
accounts, while providing a mechanism of recovery directly from third parties.
